These Terms of Service (“Terms”) govern your use of UpfrontWebsites.com (the “Site”) and the website design and development services offered by Upfront Websites (“we,” “us,” or “our”). By using the Site or requesting our services, you agree to these Terms.

1. Who we are

Upfront Websites provides website design and development services through https://upfrontwebsites.com/. Our model is simple: we build first; you pay after you love the result.

2. No deposit; payment after approval

We do not require a deposit, retainer, or credit card to begin work on a website request submitted through our questionnaire. Payment is discussed only after you have reviewed and approved the website we build for you. If you do not love the website and choose not to proceed, you owe nothing for that build under this model, subject to any separate written agreement we may later enter into with you.

We do not ask for payment card details until you approve the finished website and choose to move forward.

3. Website requests

Submitting a website request through our form is not a purchase and does not create a binding obligation to buy. It allows us to evaluate your needs and begin exploratory design and development. We may accept, decline, or pause any request at our discretion.

4. Customer support

Current customers may use the Support Center to view FAQs and submit support requests. Support response times and scope may vary by plan or agreement. Support requests must include accurate account and website information.

5. Your responsibilities

You agree to provide accurate information, content you have rights to use, and timely feedback when we request it. You are responsible for any materials you supply (text, images, logos, trademarks) and for ensuring you have permission to use them.

6. Intellectual property

Until payment is completed under an agreed arrangement, we retain ownership of design concepts, code, and deliverables we create. Upon full payment as agreed, ownership or license rights in the finished website will transfer or be granted as described in your project confirmation or invoice. You retain ownership of your own brand assets and content.

7. Acceptable use

You may not misuse the Site, attempt to disrupt our systems, submit abusive or fraudulent requests, or use our services for unlawful content or activity.

8. Disclaimer

The Site and our services are provided on an “as available” basis. To the fullest extent permitted by law, we disclaim warranties of uninterrupted availability, fitness for a particular purpose, and non-infringement. Timelines shared during a project are estimates, not guarantees.

9. Limitation of liability

To the fullest extent permitted by law, Upfront Websites will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunities arising from your use of the Site or our services. Our total liability for any claim related to a project will not exceed the amounts you actually paid us for that project.

11. Changes

We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use of the Site after updates constitutes acceptance of the revised Terms.
